Appendix D to this report may be deemed exempt – if so, to exclude the public (including the press) from a meeting of a committee it is necessary for the following proposition to be moved and adopted: “that the public may be excluded from the meeting for items which would involve the likely disclosure of information as defined in the paragraphs 3 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended) as indicated.”

We sympathise but note that no criminal offence has been prosecuted and we have not heard any information regarding a breach of a licensing condition.

We do not believe there is any wider risk to members of the public.

We are of the opinion that there may have been different ways in dealing with the situation according to who was on duty that night, not necessarily the wrong or right ways.

Our decision, therefore, is to take no further action.
